AI Act Is Transforming Content Creation – A Guide for Entrepreneurs

AI-generated content can no longer always be published without disclosure. If your company uses AI in content creation, it’s now important to pay attention to what you publish and how you communicate the use of AI. The EU AI Act’s new transparency rules became applicable on August 2, 2026. For businesses, the key now is to understand in which situations the use of AI must be disclosed and how this should be implemented in practice.

How Does the AI Act Change Content Creation in Practice?

The AI disclosure requirement applies particularly to content where an AI-generated result could influence a person’s perception of what is real. Content must be clearly labeled as AI-generated if a company publishes advertising images created with generative AI, synthetic product images, virtual brand ambassadors, AI-generated videos, or avatar characters.

If a company publishes, for example, a blog post, press release, or other text on a topic of public interest, and the content has been produced entirely by AI, this must be disclosed transparently. Such topics include health-related content, environmental claims, technical requirements and regulations, as well as other subjects where the origin of the information may influence the reader’s decision-making. If a human reviews and approves the content before publication and is responsible for its editorial content, this specific AI disclosure requirement generally does not apply.

The rules are different for images, videos, and audio. In particular, so-called deepfake content—where AI-generated or AI-manipulated content resembles a real person, place, event, or other subject and could appear authentic—must be clearly disclosed as AI-generated or AI-manipulated.

Not All AI-Generated Content Needs to Be Labeled

Many entrepreneurs are now wondering: “Does every piece of text or image created with the help of AI have to be disclosed as AI-generated?” Now that the new EU AI Act has entered into force. The short answer is: no.

Routine background processes generally do not require a separate AI disclosure. These may include, for example, spell-checking, grammar correction, translation assistance, and basic image editing such as cropping or adjusting colors.

What matters is how AI has been used, what kind of content has been produced with it, and whether the content is published in a context and format to which the AI Act’s transparency obligations apply.

A Guide for Entrepreneurs to Using AI in Content Creation

1. Find Out Where AI Is Being Used

Check your company’s own tools and those used by your partners. It’s important to know whether AI is being used to create text, images, videos, or advertising materials. Final responsibility for strategy, quality, fact-checking, and your brand voice always remains with a human. At the same time, it’s important to identify situations where the use of AI must be disclosed to customers or the public in accordance with the AI Act’s transparency obligations.

2. Keep a Human Involved in Decision-Making

AI can help you get things done faster, but it does not understand your company’s values, customers, or business goals in the same way a human does. A good practice is to establish clear guidelines within your company on what content is created with AI, who reviews the final output, and when the use of AI should be disclosed to customers.

3. Be Transparent with Your Customers About Your Use of AI

Transparency builds trust. You should disclose the use of AI whenever required by the AI Act’s transparency obligations. For example, AI-generated or significantly manipulated images, videos, or other content must be clearly labeled in certain situations if they could give viewers the impression that they depict a real person, event, or other real-world content.

For example, users should also be clearly informed when they are interacting with an AI chatbot on a website. However, not all uses of AI need to be disclosed separately. For instance, brainstorming text ideas, proofreading, or other routine uses of AI in the background do not automatically trigger a disclosure requirement.

4. Choose a Partner Who Understands AI Both as a Technology and as a Responsibility

The marketing of the future combines creativity, the efficiency of AI, and an understanding of regulation. A professional digital partner can help a company harness AI in a way that makes its content engaging, effective, and trustworthy — while ensuring that new tools are used safely and appropriately.
